Brian is a Partner at Andersen in Kenya and has an experience spanning more than 20 years in offering tax compliance, advisory services and company secretarial services, and has worked in Kenya and in Tanzania. With his many years of experience, he rose to the rank of Director in one of the international ‘Big 4’ accounting firms.
He has considerable experience in VAT, Personal Income Tax, and Corporate Tax, and has provided advisory and compliance services in various sectors (financial sector telecommunication, oil and gas, shipping, insurance, agriculture, and manufacturing).
He has assisted a number of multinational clients in tax-efficient re-structuring as well as due-diligence assignments. He has led clients through the process of registering their investment vehicles and filing annual returns with the Registrar of Companies.
He has particular expertise and bias in supporting clients across a wide range of sectors including; Parastatals, State Corporations, manufacturing, Banking, Financial Services, ICT, Agriculture and Agro-processing, Real Estate, Construction, Business Process Outsourcing and Public Sector
Additionally, Brian has resolved tax audit issues raised by the Revenue Authorities on behalf of his clients having built important relationships within these authorities. In applying his legal background, Brian reviews client contracts prior to execution, in order to establish any tax concerns that might arise in future. This way, he has been involved in advising clients to amend the terms of contracting, so as to protect the parties’ interests.
He has also been involved in lobbying the Governments of Kenya and Tanzania for changes in tax legislation that have appeared necessary in order to streamline tax law to business practice on the ground, and thus spur development as well as investment. He has actively provided submissions to the government in various key issues.
Brian has been a lead advisor in various client engagements involving financial modelling, application for waivers and remission for VAT and Customs Duty, tax health checks aimed at identifying the tax compliance gaps, conducting applications for capital allowances and obtaining approvals from the revenue authority.
Brian has led teams in reviewing tax assessments, challenging the findings of KRA on local tax laws and practices and advising clients on the parameters within which they can explore alternative dispute resolution or appeal at the Tribunal level.
He has skills and experience in reviewing client operations and identifying regulatory changes required to enable entities to compete at international markets, conducting comparative analysis of the regulatory framework in East Africa and formulating best practices to be adopted.
